In this case, it is not the seller's fault. The item was sealed but there was only one disc. The one disc is brand new quality. The seller refunded my money without any questions. I packed the disc to be returned but the seller told me not to. A very honest seller. Great doing business with you. Thank you.
Although I did not receive my item (I suspect Canada Post lost it) the seller promptly issued me a refund after I informed them of the situation. Anyone who handles an issue like that is okay in my books and I would purchase from them again if they had another item I was after.
